These Terms of Service (“Terms,” “Agreement”) govern your use of the TVP In mobile application and related services (“TVP In,” “the App,” “we,” “us,” “our”).
By downloading, accessing, or using TVP In, you agree to these Terms.

If you do not agree, do not use the App.

 
1. Overview
TVP In is a lightweight CRM and messaging tool that enables verified users (such as hairstylists, bartenders, creators, nightlife workers, independent professionals, and service businesses) to send SMS and MMS communications to their contacts who have provided explicit prior consent.

TVP In supports relationship-based messaging including:

service updates
event notifications
promotional offers
photos of services or products
social invites
reminders and general client communication
ALL messaging must be permission-based and compliant with carrier and regulatory guidelines.

 
2. Eligibility
You must be:

At least 18 years old
Authorized to contact each recipient
Able to comply with carrier, regulatory, and anti-spam rules
You agree to use TVP In only with contacts who have knowingly and willingly provided their mobile number and consent.

 
3. User Responsibilities
You are solely responsible for:

The content of all messages you send
Ensuring every recipient has provided explicit consent
Maintaining accurate records of consent
Respecting all opt-out requests
Honoring STOP/HELP requirements
Complying with all laws and carrier rules (A2P 10DLC, TCPA, CTIA, etc.)
TVP In is not liable for illegal, abusive, or unauthorized use of the messaging features.

 
4. Consent Requirements
Before sending any SMS/MMS messages through TVP In, you must obtain:

Explicit, documented opt-in from each recipient.
Acceptable opt-in methods include:

Consent via web or QR-linked sign-up page
The recipient enters their phone number and checks a consent box.
Consent via in-app contact form
The recipient provides their number directly and checks a consent box authorizing messages.
Pre-existing personal or professional relationship + confirmed consent
You must mark the “Contact Consented” checkbox to verify that the person gave direct permission to receive messages.
Double opt-in (optional)
The recipient replies YES to confirm subscription.
All opt-in submissions must be collected in good faith.
You may not message individuals who:

did not provide consent
withdrew consent
were added from purchased or third-party lists
 
5. Prohibited Contact Lists
You may NOT upload, import, or message:

purchased lists
rented lists
scraped phone numbers
numbers collected without disclosure
numbers collected by third parties
Violations may result in:

carrier blocking
campaign suspension
account termination
legal liability
 
6. Opt-Out Requirements (STOP)
All messages sent through TVP In must include opt-out instructions.

Recipients may reply STOP at any time to unsubscribe.

When a STOP request is received:

The App immediately blocks further messages to that number from that sender
A confirmation message is returned
You must not attempt to re-contact recipients who opted out unless they explicitly re-opt in.

 
7. HELP Replies
If a recipient texts HELP, the App returns:

“For assistance, contact [email protected]. Msg & data rates may apply.”
 
8. Messaging Content Rules
You agree not to send:

illegal content
hate speech
harassment or threats
adult/explicit content
drugs or controlled substances
firearms or weapons
financial scams, phishing, or fraud
misleading marketing
SHAFT content (Sex, Hate, Alcohol, Firearms, Tobacco) where prohibited
Marketing content must be truthful and permission-based.

 
9. User-Generated Content
You understand and agree that:

You generate all message content
TVP In does not create, edit, or approve your messages
You are solely responsible for compliance
TVP In is not liable for penalties, carrier filtering, damages, or legal action resulting from your messages or contact lists
 
10. Carrier Compliance
By using TVP In, you agree to follow:

A2P 10DLC rules
Carrier guidelines
CTIA Messaging Principles
TCPA (Telephone Consumer Protection Act)
Local and international SMS regulations
Failures may lead to:

message filtering
number/campaign suspension
account termination
 
11. Privacy & Data Handling
We collect and store:

consent submissions
phone numbers
sender IDs
timestamps
opt-out events
message logs (non-content metadata only)
We do not sell or rent contact data.

12. Account Termination
We may suspend or terminate accounts that:

violate these Terms
send prohibited content
message without consent
trigger high complaint or opt-out rates
violate A2P 10DLC rules or carrier policies
 
13. Limitation of Liability
TVP In is not liable for:

message delivery failures
carrier filtering
campaign rejections
lost business
damages from misuse of messaging features
legal or regulatory penalties incurred by the user
Your use of the App is at your own risk.

 
14. Changes to Terms
We may update these Terms at any time.
Continued use of the App after updates constitutes acceptance.
